Refund and Recurring Billing Policy

Definitions: The following definitions are intended to clarify the meaning of terms contained in the provisions of this agreement and to provide context for an understanding of the document, as a whole.

(a). KidsintheHouse – The company Kids in the House, LLC
(b) User – A person who has signed up through the Kids in the House Website (http://www.kidsinthehouse.com)
(c) digital product(s) —Intangible good(s) that exist in the digital form purchased through the Kids in the House Website (http://www.kidsinthehouse.com)


Refund and returns
If you are unable to view or access the digital product(s) purchased from the Kids in the House website for any reason including, but not limited to, browser/compatibility internet connectivity, you may request a refund by following the procedures outlined in this document.

Kids in the House, LLC will review each request and retains the right access server and website statics to confirm whether said digital product(s) have been accessed by the user requesting the refund and the duration of time spent watching / consuming said content. Kids in the House, LLC has the sole discretion to determine as to whether a refund will be issued to a person who has been determined to have accessed all or part of said digital content. Upon successful review and acceptance of refund request, Kids in the House will refund the payment made no later than 60 calendar days from day of refund request.

Procedure for refund request:
Send an e-mail to "office@kidsinthehouse.com" with the reason for the refund request, the order number (which should have been provided in the e-mail receipt confirmation and on the redirected checkout page upon order completion) and if possible the technical specifications for the particular computer or mobile system used to purchase the product(s)

Recurring billing and order cancellation:
For product(s) marked as subscriptions and broken down by specified time periods, Kids in the House retains the right to automatically renew such products and re-charge the order for a maximum of 10 years from original date of purchase. Unless specifically cancelled by user, orders will contiue to process using the securely stored billing information provided at time of purchase. The user will retain the ability to access the premium digital content under the same or modified terms and conditions as with the original purchase.

Automatic renewal:
Unless you notify KidsintheHouse before the end of the applicable subscription period that you want to cancel, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee using any credit card or other payment mechanism we have on record for you. Subscriptions can be cancelled at any time by following the procedures for cancellation outlined in this document.

Procedure for cancelling automatic recurring billing:
Send an e-mail to “office@kidsinthehouse.com” with the original order number for the subscription based product and with the subject “Cancel Subscription”.

Updating billing information:
Billing information can be updated via the Kids in the House website by accessing the "my subscription" tab on a user's profile while logged in.

Security and data:
Kids in the House is using an industry standard gateway for payment processing through Authorize.net which adheres to modern security protocols. Customers agree to indemnify Kids in the House against any breach of data or security out of their direct control and not deemed directly relocatable to their negligence, which includes but is not limited to security breaches due to:

Indemnification:
You agree to indemnify and hold harmless KidsintheHouse, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorney's fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

Statue of limitations:
The parties agree that any action in relation to an alleged breach of this Agreement shall be commenced within three years of the date of the breach, without regard to the date the breach is discovered. Any action not brought within that three year time period shall be barred, without regard to any other limitations period set forth by law or statute.

No guarantee:
KidsintheHouse make no guarantee as to the business benefits of utilizing the services described herein. The Client has the sole discretion and responsibility for usage of the products of this agreement.

Governing law:
This Agreement shall be construed in accordance with, and governed in all respects by, the laws of the State of California, without regard to conflicts of law principles.

Enforce-ability:
If a judicial, administrative, or arbitrary body finds any provision in this agreement are found to be unenforceable, that fact shall not affect the enforce-ability of the remaining provisions and the court shall enforce the remaining provisions to the fullest extent permitted by law

Entire agreement:
This Agreement (together with the website TOS, Privacy Policty and other legal documents linked to on KidsintheHouse.com) constitute(s) the entire agreement between the parties with respect to its subject matter and constitutes and supersedes all prior agreements, representations and understandings of the parties, written or oral.
