The FMLA is only one type of protection that pregnant women have, that working mothers have. It has a threshold of 50 persons, which is a pretty high threshold. Most of the other legislation that offers protection have a much lower threshold. For example, the Civil Rights Acts Title 7 and Pregnancy Discrimination Act, have a threshold of 15 persons. It's much better to get protection. It's much easier to get protections under these types of legislation. Similarly, most states have a comparable or similar law to the FMLA which might have lower employee restrictions. Whatever it is, if you are covered by your state laws, you're still entitled to protection from discrimination. You might not be entitled to unpaid leave and job protection. However, if they give leave for other types of disabilities, they cannot give it to you because you're pregnant. You do have a type of job protection in that sense.
