Useful Legal Tips for Parents: Why You Need to Fight Medical Malpractice

patient doctor conflict

Most people, when they think of medicine, doctors, and science, immediately draw positive pictures and inferences, conjuring scenes of healing and recovery, with loved ones rushing to the bedside, filled with joy. The truth is, medicine is messy, often contradictory, and filled with doctors who care more about making a quick buck and appeasing their corporate overlords than they do about actually healing the afflicted. And history is full of these examples—of pharmaceutical companies giving their customers untested and dangerous medications; of using people as guinea pigs to test the effects of their pills.

Medicine doesn’t always heal

Anyone who has the slightest grasp of history is aware of this, but when children, the most vulnerable members of our society, are the ones targeted, who lack insight and the natural suspicion that comes so easily to adults and will quite literally swallow anything that is given to them by any figure with a bit of authority, a nightmare begins to fester, and it’s the children, and their scared and confused parents, who end up the ones with no help, at the mercy of a judicial system that basically caters to the highest bidder. Unless you have help.

Lawyers that stand for the victims of firms and pill pushers are quite often the difference between suffering, sometimes fatal, and unpunished negligence. It’s always a good idea to reach out for a helping hand when you’re down, and lawyers are the hands that will lift you up, you and your children, especially when it comes to things like birth injuries. Justice has become somewhat of a luxury, but thankfully it’s still possible with the right people beside you.

Types of malpractice with children

Obviously, there are dozens of things that can go wrong during any childbirth, even with the great level of preparation and care that is ideally taken. Injuries like fractures can occur as the bones of a newborn are, of course, very fragile, and any wrong move during the delivery can cause a fracture. Sometimes, in very tragic scenarios, the umbilical cord can wrap around the newborn's throat and asphyxiate it.

The lawyers at the firm work on a contingency fee, which means they don’t get paid until they acquire financial compensation from the accused party, or a lawsuit settlement from the judicial system, so you don’t have to fork over hundreds, maybe thousands of dollars, to chase uncertain justice. This is the fairest arrangement one can hope for, especially when someone’s already distraught with grief and worry and doesn’t have the state of mind for finances and the like.

Things you can do yourself

In today’s world, it’s never a bad idea to do some research for yourself and gather some basic knowledge beforehand, not only for your peace of mind but so when a doctor displays a certain lack of concern or precaution involving your child, you read the warning signs and maybe prevent a tragedy. Forewarned is forearmed, after all.

Of course, don’t just read and trust any source. The internet can be a dangerous place, after all, to the detriment of honest and trusting souls. Instead, use sites that not only look professional but also list the sources for their information.

There are also a number of other little signs and warning signals one should watch out for, but they become clear by themselves the more time you spend on the web, such as the use of proper English grammar and the general feel of the language used. You’d be surprised to learn how many scam sites and the like can often be found by a simple skimming of the text.

You should also not be afraid of consulting a lawyer beforehand, as there’s nothing like professional help, and an extra set of eyes scanning for potential dangers, especially when you’re already busy preparing for your child. As the birth injury consultations are free of charge anyway, you quite literally lose nothing by reaching out.

In the end, don’t be afraid to speak up. If there’s one thing you take away from this, it’s that too often we end up in situations that could have been easily avoided if we’d just said something when we were told things that didn’t sound quite right or weren’t clear on something. Overcome the urge to just nod and go along, and you may prevent unnecessary suffering. After all, nothing is more important than your children, and no one is more important to them than their parents.
